Pete’s Real Food, LLC (“Pete’s Real Food,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our websites, applications, email programs, SMS programs, and other online services that link to this Policy (the “Services”).
By using the Services, you agree to this Privacy Policy and our Terms of Service. If you do not agree, please do not use the Services.
1) What we collect
We collect the following categories of information:

Identifiers: name, email address, postal address, phone number, IP address, account identifiers, and cookie identifiers.

Commercial information: order history, products viewed or considered, subscription status, preferences (like diet interests), promo participation.

Internet/network activity: device info, pages viewed, referring/exit pages, date/time stamps, and interactions with our emails and ads.

Geolocation data: general location (for example, city/state) inferred from IP or shipping address.

We collect information directly from you (checkout, account setup, email/SMS sign-up), automatically (cookies, pixels, analytics), and from third parties (marketing partners, advertising platforms, data enrichment services, and service providers).
2) How we use information
We use personal information to:

Provide, operate, and improve the Services and our products, including order processing, fulfillment, shipping, and customer support.

Manage subscriptions, accounts, loyalty/referral programs, promotions, and surveys.

3) How we disclose information
We disclose personal information to:

Service providers/processors: companies that host, operate, secure, or support the Services; process payments; handle fulfillment, shipping, analytics, advertising measurement, customer service, or email/SMS delivery. They may only use information to perform services for us.

Advertising and analytics partners: to measure performance, understand audiences, and, if you have not opted out, tailor marketing.

Business transfers: if we sell or transfer all or part of our business or assets (including a brand or product line), data may be transferred as part of that transaction, consistent with applicable law.

Legal/compliance: to comply with law, respond to lawful requests, protect our rights, users, or the public, and prevent fraud or security incidents.

4) “Sale” or “Sharing” of personal information (California and similar laws)
Under the California Consumer Privacy Act as amended by the CPRA, a “sale” can include disclosing identifiers (like email addresses) to another business for money or other valuable consideration. “Sharing” can include disclosing personal information for cross-context behavioral advertising.

What we may sell/share: Identifiers (such as email addresses) and internet/network activity for marketing and advertising purposes, including to third-party meal-delivery brands that may market directly to you, and to ad/analytics partners for cross-context ads.

What we do not sell/share: We do not sell or share information where prohibited by law, and we do not sell, rent, loan, trade, lease, or transfer for profit any phone numbers or customer information collected through our SMS Program (see Section 11).

Who can opt out: We offer a “Do Not Sell or Share” choice to all users, not just California residents. We also honor Global Privacy Control (GPC) signals where required.

5) Your privacy choices

Do Not Sell or Share My Personal Information:
To opt out of the sale or sharing of your personal information for marketing/advertising, email hello@petesrealfood.com. We also honor GPC signals, where required. -
Email marketing:
Opt out of promotional emails by clicking “unsubscribe” in any email or by emailing hello@petesrealfood.com. You may still receive transactional or service messages. -
SMS/MMS marketing:
To opt out, text STOP to the number you receive messages from or follow the instructions in Section 11. -
Cookies/tracking technologies:
Use your browser settings to block or delete cookies. Where available, you can adjust preferences in our on-site cookie controls. -
Access/correct/delete/appeal (U.S. state rights):
If you are a resident of California, Colorado, Connecticut, Utah, Virginia, or similar jurisdictions, you may request access, correction, deletion, portability, and appeal certain decisions by emailing hello@petesrealfood.com. We will verify your request and respond as required by law. Authorized agents may submit requests with proof of authority. -
EU/UK residents:
Where the EU/UK GDPR applies, you may have rights to access, rectify, delete, restrict, object to processing (including direct marketing), and portability. You may also lodge a complaint with your local supervisory authority. Contact hello@petesrealfood.com to exercise rights.
We do not discriminate against you for exercising privacy rights.
6) Cookies, pixels, and analytics
We and our partners use cookies, pixels, tags, SDKs, and similar technologies to operate the Services, remember preferences, analyze usage, and, if you have not opted out, for advertising and measurement. For example, we use Google Analytics to understand site usage. You can manage cookies via your browser settings and, where available, our on-site cookie controls.
Example cookies may include: _session_id, _shopify_visit, _shopify_uniq, cart, _secure_session_id, storefront_digest, and third-party analytics or ad cookies. Cookie lifetimes vary.
7) Data retention
We retain personal information as long as needed for the purposes described in this Policy, to comply with legal obligations, resolve disputes, enforce our agreements, and for legitimate business needs. Retention periods vary by data type and context.
8) Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is 100% secure. If you believe your account or interaction with us is no longer secure, contact us right away.
9) Children’s data
Our Services are not intended for children under 13, and we do not knowingly collect personal information from them. If we learn we have collected such information, we will delete it.
10) International transfers
We may process and store information in the United States and other countries, where laws may provide different levels of protection than your jurisdiction. Where required, we use appropriate safeguards for cross-border transfers.
11) SMS/MMS Mobile Messaging Program
If you opt into our SMS/MMS program, we will use your phone number to send recurring messages (for example, order updates and promotions) as described in our Mobile Terms. Message and data rates may apply; frequency varies. You can opt out at any time by texting STOP to the number you receive messages from.
We do not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or customer information collected through the SMS Program to any third party for their own direct marketing. We may disclose information as necessary to deliver messages and comply with law. See our Mobile Terms for more detail.
12) Shopify and other third-party services
Our store is hosted on Shopify Inc. Shopify provides the e-commerce platform that allows us to sell products and services to you. Your data may be stored through Shopify’s data storage, databases, and the general Shopify application. Shopify stores your data on a secure server behind a firewall. Payments. If you choose a direct payment gateway, your card data is handled by the payment processor and secured in accordance with PCI-DSS. We do not store full card numbers.
Links and third-party sites. When you click links on our site, you may be directed to third-party websites. Their privacy practices govern your interactions on those sites. We encourage you to read their policies.
13) California privacy notice (CPRA)
This section supplements other parts of the Policy and applies to California residents.
Categories collected: identifiers; commercial information; internet/network activity; geolocation (general); inferences; and user content.
Sources: you; your devices; our service providers; advertising/analytics partners; and other partners.
Purposes: as listed in Section 2.
Disclosures for business purposes: service providers/processors (hosting, payments, fulfillment, shipping, analytics, advertising measurement, customer support); legal and compliance; business transfers.
Sale/Sharing: as described in Section 4, we may sell/share identifiers (for example, email addresses) and internet activity for marketing/advertising. You may opt out at any time by emailing hello@petesrealfood.com or by using a browser with GPC. We do not sell/share SMS Program numbers.
Sensitive personal information: we do not use or disclose sensitive personal information for purposes requiring the right to limit under CPRA.
Retention: see Section 7.
Your CPRA rights: access/know, delete, correct, portability, opt out of sale/share, and non-discrimination. Submit requests by emailing hello@petesrealfood.com. We will verify your identity before fulfilling requests. You may use an authorized agent with valid authorization.
Notice of financial incentive (if applicable): If we offer discounts, rewards, or similar benefits in exchange for providing personal information (for example, email sign-up), participation is voluntary. The value of the incentive is reasonably related to the value of the data and the benefits associated with program participation. You may withdraw at any time by unsubscribing or emailing us.
14) Nevada residents
Nevada residents may opt out of the sale of “covered information” as defined by Nevada law by emailing hello@petesrealfood.com with “Nevada Do Not Sell Request” in the subject line.
15) Changes to this Privacy Policy
We may update this Policy from time to time. The “Effective date” above shows when it was last revised. Material changes will be posted on this page. Your continued use of the Services after changes are posted means you accept those changes.
